Prescott Had Collector Status, Bought Firearms Legally

Maryland State Police said Neil Prescott bought 16 firearms between May of 2011 and July of 2012. He passed all background checks and was permitted to buy more than one gun per month.

 

Maryland State Police say Neil Prescott legally purchased 16 weapons and component parts between 2011 and 2012, and had obtained collector status that allowed him to buy more than one gun per month. 

Prescott, a Crofton resident accused of threatening to shoot former employees, did not violate any laws when he bought an array of weapons, including several pistols, revolvers and receivers. Maryland State Police said Prescott passed all background checks required to purchase firearms. His collector status was also properly applied, police said.

Collector status can be granted to to a person who "devotes time and attention to acquiring certain types of regulated firearms for the enhancement of the collector's personal collection," and who does not act as a dealer. Applicants are required to provide a signed and notarized affidavit. 

Prosecutors on Thursday issued a warrant for Prescott's arrest on a misdemeanor phone misuse charge, which carries a sentence of up to three years in jail and a $500 fine. He was detained last week after police said he threatened former employees at a Pitney Bowes office in Capitol Heights. Police said they believe they may have stopped a potential mass shooting after discovering a collection of weapons inside Prescott's home.

Prescott remains hospitalized voluntarily for a mental health evaluation.

Here's a list of Prescott's purchases, according to the Maryland State Licensing Division. Note that receivers, which house the operating mechanisms, are considered regulated firearms under Maryland state law.

  • May 14, 2011 – Beretta .40 caliber pistol
  • June 30, 2011 – lower receiver

  • August 13, 2011 – Ruger .357 revolver
  • December 10, 2011 – Springfield .9mm pistol
  • April 10, 2011 – five lower receivers
                        - two Kahr Arms 9mm pistols.
  • April 19, 2012 – Saiga .762 caliber rifle

                           - Ruger .45 caliber pistol

  • June 16, 2012 – Beretta 9mm pistol

                           - Sig Sauer 9mm pistol

  • June 20, 2012, and July 14, 2012 – Weapons not yet entered into state database.

Really? Well I'm glad he was dumb enough to make a threatening call in a way they could trace it back to him. I wish it was possible to have a conversation on how to realistically prevent someone like this from being so well armed, but seems we're too polarized and it always degrades down to name calling and personal attacks. It's a shame...

Someone like what? What does well armed threaten? How is it any different to have 1 handgun and 1 rifle? How do the others matter? I could have a conversation like that but you have to be reasonable also.
Explain how the quantity matters first.

Unfortunately Ronald you only prove my point. Look at my post, does it say anything about taking away all gun rights? I am comfortable with responsible gun owners owning appropriate weapons for protection if they so choose, same with collectors. I am uncomfortable that police went to search a home of someone of questionable mental status not knowing he was that well armed. The conversation I want to have to try and find a way to prevent people intending to great harm from amassing a collection of weapons and ammunition.

Instead you've jumped to conclusions, insulted a stranger, read things you wanted to see in my reply to advance a personal point of view. It is that discourse in the country, the "winner takes it all" mentality with no middle ground, that only like-minded people have anything to contribute to a conversation, the inability to look at opinions you don't agree with to see if they can help refine your thinking, etc. that leaves me so disheartened.

Ron, you truly are the poorest representation of the American veteran population that I have ever experienced. You speak often of rights, and yet have forgotten those rights you fought for apply to all Americans, not just those you agree with. You spout on and on (quite childishly) about freedoms and rights while trampling on the rights of others to have an opinion that differs from your own. Maybe you if actually tried reading and comprehending others' posts before ranting like a raving lunatic, you might actually learn something. Forgive me if I don't hold my breath though while waiting for that to happen.

Most people who are "well armed" never bother anyone. Im not saying that this guy had mental issues; however, The focus should be on preventing people with mental issues from obtaining firearms.

And no one ever drove an automobile while under the influence and killed someone. My point is that, just like a DUI, this scenario had three inseparable parts, and citing just the gun as the problem, does little if anything to address the other two. To an unstable person REALLY meaning to do harm, the mechanism is just an aftertought.

This article seems to be making a big deal about the collector status and how he could buy more than one gun a month. From the picture and the description of the guns he purchased, this is really a non issue here. He could have just as well purchased all the same guns buying once a month. The once a month restriction doesn't apply to at least 3 possibly 4 of the guns pictured.

Dexter - we point out the issue of the collector's status to provide context to how and why he may have owned some of the guns. To get that status, it's another step beyond the typical background check. But it also offers some insight into how it's not necessarily unusual or illegal for a person to own multiple firearms and acquire many within a short period of time. This may be common knowledge among people who own guns. I'm not sure it's common knowledge among people who don't.

Lots of people I know own lots of different types of guns and they would never use them other than for the sport of shooting them. Shooting is an enjoyable sport and shooting different types/caliber of guns is also enjoyable.

Speaking of and sorry for a little off topic, but does anyone know of a decent place to go shoot clay pigeons or skeet shoot (no jokes please) locally with shotguns? I know of the local indoor ranges but sometimes its nice to get the long barrells out and shoot moving targets!
